Terms of Use for Ora

These Terms of Use ("Terms") govern your use of the Ora mobile application (the "App") operated by 1532863 B.C. Ltd. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

  1. Acceptance of Terms

By accessing or using Ora, you confirm that:

  • You are at least 13 years old (or the age of majority in your jurisdiction)

  • You have the legal capacity to enter into these Terms

  • You will comply with all applicable laws and regulations when using the App

If you are under 18, you must have permission from a parent or guardian to use the App.

  1. About the App

Ora is a personal guidance and self-improvement application that provides:

  • Personalized personality assessments and archetype identification

  • Daily guidance readings with actionable directives

  • Energy scans and personal reflections

  • Bond readings between you and people in your life

  • Weekly updates and personalized notes

All content generated by Ora, including personality interpretations, daily guidance, bond analyses, energy scans, and any other content, is for entertainment and personal reflection purposes only. Ora is not a substitute for professional advice of any kind.

  1. License to Use the App

3.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal iOS device for personal, non-commercial use, subject to these Terms.

3.2 Restrictions

You may NOT:

  • Copy, modify, distribute, sell, or lease any part of the App

  • Reverse engineer, decompile, or disassemble the App

  • Use the App for any illegal or unauthorized purpose

  • Attempt to access or interfere with the App's servers or networks

  • Use automated tools (bots, scrapers) to access the App

  • Resell, sublicense, or redistribute access to the App

  • Reproduce or redistribute Ora's content, readings, or interpretations for commercial purposes

  1. Subscriptions and Payments

4.1 Subscription Plans

Ora offers premium subscription options that may include:

  • Monthly Subscription: Auto-renews every month

  • Annual Subscription: Auto-renews every year

Pricing is displayed in the App and may vary by region. All prices are in your local currency and include applicable taxes.

4.2 Free Trial

We may offer a free trial for new users. You will not be charged until the trial period ends. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged.

4.3 Payment and Billing

  • Payments are processed through Apple's App Store (In-App Purchase)

  • Payment will be charged to your Apple ID account at confirmation of purchase

  • Subscriptions automatically renew unless you cancel at least 24 hours before the current period ends

  • Your account will be charged for renewal within 24 hours prior to the end of the current period

  • You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings

4.4 Cancellation and Refunds

  • You may cancel your subscription at any time from your Apple ID Account Settings

  • Cancellation takes effect at the end of your current billing period

  • No refunds for partial subscription periods

  • Refund requests must be made through Apple, as all payments are processed by Apple's App Store

  • We do not have access to Apple's refund policies or decisions

4.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will:

  • Apply to new subscribers immediately

  • Apply to existing subscribers upon their next renewal period

  • Be communicated to you in advance via in-app notification

  1. User Data and Content

5.1 Your Data

You retain all ownership rights to the personal information you provide to Ora, including:

  • Your name and date of birth

  • Bond connections you create

  • Preferences and quiz responses from onboarding

  • Daily check-in responses and reflections

5.2 Data Storage

By using the App, you acknowledge that:

  • Your personal data is used to generate personalized guidance and readings

  • Your data is stored securely on encrypted servers

  • Bond connections and reading history are associated with your account

  • You can delete your data at any time through the App's settings

5.3 Content Accuracy

All personality interpretations, daily guidance, bond analyses, energy readings, and other content provided by Ora are generated for entertainment and personal reflection. We do not guarantee the accuracy, completeness, or reliability of any generated content. You acknowledge that:

  • Personality assessments are interpretive and based on your quiz responses

  • Daily guidance and bond analyses are personalized suggestions, not predictions or facts

  • Energy scans are experiential features, not scientific measurements

  • No content in the App constitutes professional, medical, psychological, or financial advice

  1. Intellectual Property

6.1 Our Ownership

All rights, title, and interest in the App, including:

  • Software code, design, and functionality

  • Ora name, logo, and branding

  • All written content, interpretations, and readings

  • The 12-archetype personality system

  • Visual design, animations, and user interface

  • Metal shader code and particle systems

6.2 Your Ownership

You retain all rights to the personal data you provide (profile details, bond connections). We do not claim ownership of your personal information.

  1. Disclaimers and Limitation of Liability

7.1 App Provided "As Is"

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose

  • Warranties that the App will be uninterrupted, secure, or error-free

  • Warranties regarding the accuracy or reliability of generated content

7.2 No Professional Advice

Ora is an entertainment and personal reflection tool. It is NOT a substitute for professional advice. The daily guidance, bond analyses, and energy interpretations provided by Ora should not be relied upon for:

  • Mental health diagnosis or treatment

  • Medical advice or health decisions

  • Legal, financial, or professional counseling

  • Relationship decisions or assessments of compatibility

If you are experiencing a mental health crisis, please contact a qualified healthcare provider or crisis hotline immediately.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1532863 B.C. LTD. SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of data, profits, revenue, or business opportunities

  • Damages arising from your use or inability to use the App

  • Damages arising from reliance on any content, readings, or guidance provided by the App

  • Damages caused by third-party services

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you in full.

  1. Indemnification

You agree to indemnify, defend, and hold harmless 1532863 B.C. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms

  • Your use or misuse of the App

  • Your violation of any third-party rights

  • Any decisions you make based on content provided by the App

  1. Privacy

Your privacy is important to us. Please review our Privacy Policy at https://orauniverse.framer.website/#privacy to understand how we collect, use, and protect your personal information.

By using the App, you consent to our Privacy Policy.

  1. Termination

10.1 Your Right to Terminate

You may stop using the App at any time. To terminate your account:

  • Delete the App from your device

  • Cancel your subscription through Apple ID Account Settings

10.2 Our Right to Terminate

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if:

  • You violate these Terms

  • Your use of the App poses a security or legal risk

  • We discontinue the App or service

Upon termination:

  • Your license to use the App will end immediately

  • You will lose access to the App and any subscription benefits

  • You may request deletion of your data by contacting us

  1. Changes to These Terms

We may update these Terms from time to time. When we make changes:

  • We will update the "Last Updated" date at the top of this document

  • For material changes, we will notify you via in-app notification

  • Continued use of the App after changes constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.

  1. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  • Informal negotiation: Contact us at support@tensai.tech to attempt resolution

  • Binding arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in British Columbia, Canada, in accordance with the rules of the British Columbia International Commercial Arbitration Centre (BCICAC)

  • Small claims court: You may bring claims in small claims court if they qualify

12.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis only. You waive any right to bring claims as part of a class action, collective action, or representative proceeding.

  1. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

  1. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1532863 B.C. Ltd. regarding your use of the App and supersede any prior agreements.

  1. Apple-Specific Terms

16.1 Acknowledgment

You acknowledge that these Terms are between you and 1532863 B.C. Ltd., not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

16.2 Scope of License

Your license to use the App is limited to a non-transferable license to use the App on an Apple-branded device that you own or control, as permitted by Apple's App Store Terms of Service.

16.3 Maintenance and Support

1532863 B.C. Ltd. is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide support.

16.4 Warranty

To the extent permitted by law, Apple provides no warranty for the App. Any claims, losses, or damages arising from the App are the sole responsibility of 1532863 B.C. Ltd., not Apple.

16.5 Product Claims

1532863 B.C. Ltd., not Apple, is responsible for addressing any claims relating to the App, including:

  • Product liability claims

  • Claims that the App fails to conform to legal requirements

  • Claims arising under consumer protection laws

16.6 Intellectual Property

In the event of a third-party claim that the App infringes intellectual property rights, 1532863 B.C. Ltd., not Apple, will be responsible for investigation and defense.

16.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

  1. Information We Collect

1.1 Information You Provide

When you use Ora, you may provide:

  • Personal details: Your name and date of birth, used to personalize your experience

  • Onboarding preferences: Life stage, relationship status, personal focus areas, coping style, communication patterns, social energy, vulnerability preferences, personality quiz responses, manifestation intentions, and color selection

  • Bond connections: Names, relationship types, and answers to relationship questions about people you add as bonds

  • Reflections: Oracle questions you ask, daily check-in responses, and energy scan answers

  • Notification preferences: Your choices for daily guidance, weekly updates, and reminder notifications

1.2 Automatically Collected Information

We automatically collect:

  • Device information (iOS version, device model) for compatibility purposes

  • Device tokens for push notification delivery

  • App usage data (session timestamps, feature usage) to improve the App

  • Error logs and crash reports to diagnose and fix technical issues

1.3 Information We Do NOT Collect

  • We do not collect your email address, phone number, or contact information (unless you sign in with Apple or contact us for support)

  • We do not track your location

  • We do not access your camera roll or photo library (the energy scan feature uses a live camera feed that is not recorded or stored)

  • We do not collect financial or payment information (all payments are handled by Apple)

  1. How We Use Your Information

We use your information to:

  • Generate your personality profile and personalized daily guidance

  • Deliver personalized bond readings based on your relationship quiz answers

  • Provide energy scan interpretations based on your responses

  • Generate weekly updates and personalized notes tailored to your profile

  • Store your bond connections and interaction history

  • Manage your notification preferences and deliver notifications

  • Track your subscription status and premium features

  • Improve the App by analyzing usage patterns and fixing bugs

  • Provide customer support when you contact us

  1. Data Storage and Security

3.1 Data Storage

  • Your personal data is stored securely on encrypted servers (Supabase)

  • Some data is also cached locally on your device for offline access

  • We use industry-standard encryption and security practices to protect your data

  • If you delete your account, all associated data will be permanently removed from our servers

3.2 Camera Usage

  • The energy scan feature uses your device's camera to create an interactive visual experience

  • No photos or video are captured, recorded, or stored during the energy scan

  • The camera feed is used only for the live visual effect and is not transmitted anywhere

3.3 Data Security

  • Data transmitted between the App and our servers is encrypted in transit

  • Data stored on our servers is encrypted at rest

  • We use secure authentication (Apple Sign In and anonymous auth) to protect your account

  • We regularly review our security practices to ensure your data remains protected

  • Purpose: Secure data storage, user authentication, and serverless functions

  • Data Shared: Your profile data, quiz responses, bond connections, and interaction history

  • Purpose: Generate personalized daily guidance, bond readings, and oracle responses

  • Data Shared: Your personality profile, archetype, quiz responses, and interaction context (no identifying information such as full name or email is sent)

4.3 OpenAI (AI Content Generation)

  • Purpose: Generate daily reading content and area-specific guidance

  • Data Shared: Archetype-level data for content generation (no personally identifying information)

  • Purpose: Process and manage subscription purchases

  • Data Shared: Anonymous user ID and subscription status

  • Purpose: Process subscription payments

  • Data Shared: Anonymous purchase receipts and subscription status (handled entirely by Apple)

  • Purpose: Deliver daily guidance notifications, weekly updates, and reminder notifications

Important: We do not sell, rent, or share your personal information with third parties for marketing or advertising purposes. We do not use third-party advertising or tracking SDKs.

  1. Your Control Over Your Data

5.1 Access and Modification

You can view and modify your data at any time:

  • Edit personal details: Settings > Edit Birth Details

  • Manage bonds: Delete individual bond connections from the Bonds tab

  • Manage notifications: Settings > Notifications

5.2 Data Deletion

You can delete your data at any time:

  • Delete individual bonds from the Bonds tab

  • Delete your entire account: Settings > Danger Zone > Delete Account (this removes all data from our servers)

  • Delete the App from your device to remove all locally cached data

Once deleted, your data cannot be recovered.

  1. Data Retention

  • Profile data and preferences: Stored on our servers until you delete your account

  • Bond connections and readings: Stored on our servers until you delete them or your account

  • Oracle question history: Stored on our servers associated with your account

  • Energy scan history: Stored on our servers associated with your account

  • Camera data: Never stored. The camera feed is used only during the live energy scan experience

  1. Your Privacy Rights

Depending on your location, you may have the following rights:

7.1 General Rights (All Users)

  • Access: View your data directly in the App

  • Deletion: Delete your data at any time (see section 5.2)

  • Correction: Edit your personal details in Settings

7.2 GDPR Rights (European Union Users)

If you are located in the EU, you have additional rights under GDPR:

  • Right to access your personal data

  • Right to rectification of inaccurate data

  • Right to erasure ("right to be forgotten")

  • Right to object to data processing

  • Right to restrict processing

  • Right to data portability

  • Right to lodge a complaint with a supervisory authority

7.3 CCPA Rights (California Users)

If you are a California resident, you have rights under CCPA:

  • Right to know what personal information we collect

  • Right to delete your personal information

  • Right to opt-out of sale of personal information (Note: We do NOT sell your data)

  • Right to non-discrimination for exercising your privacy rights

Ora is rated 4+ on the App Store. We do not knowingly collect personal information from children under 13 without parental consent. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at support@tensai.tech, and we will take appropriate action.

  1. International Data Transfers

Your data may be processed and stored on servers located in different regions. We ensure appropriate safeguards are in place to protect your data in accordance with applicable privacy laws. If you contact us for support via email, your message may be processed in Canada.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. When we make changes:

  • We will update the "Last Updated" date at the top of this policy

  • For material changes, we will notify you via an in-app notification
